Contract Law

Law of contracts regulates, enforces, and interprets contracts pertaining to the transfer of products, services, assets, or money. A party who suffers harm has access to remedies in addition to the rights and responsibilities that are contractually owed to them. A contract law also outlines how remedies can be pursued. The Indian Contracts Act, 1872 regulates contract law in India. According to section 2(h) of the Act, a contract is an agreement that is enforceable by law. Different kinds of contracts are covered by the Act, including bailment, indemnity, agency, among others. A contract may also be invalid, voidable, or valid based on its validity.

Property Law

Civil law dealing with people's property is known as property law. It stipulates the limitations that apply to people regarding the property of others, as well as their rights regarding the use or transfer of their own property. Personal property and real property are the two main categories of property. Intangible assets such as cars, furniture, stocks, and so on are considered personal property. Buildings, land, and other immovable assets are referred to as real property. The Indian Contract Act of 1872, the Indian Easement Act of 1882, and other laws govern Indian property law.

According to Ivor Jennings, administrative law defines the structure, authority, and responsibilities of administrative authorities. The executive branch of government operates in this way. Even though there are specialized courts or tribunals for administrative law disputes, they are rarely codified.

Types Of Civil Cases Handled by Civil Lawyers

The primary difference between criminal and civil litigation is that in the former, the parties are not seeking criminal charges; instead, they are seeking monetary damages. Criminal cases are often prosecuted by the state, while civil cases are prosecuted by both parties, with assistance from legal counsel. Contract disputes

Contract conflicts arise when one or more parties cannot or do not fulfill their obligations. There are times when this happens because a contract is drafted in such a way that the two parties have different expectations, but more often than not, it occurs because a party overextends itself and lacks the resources to meet its obligations.

Property disputes

In property law, disputes over ownership and damage to property are dealt with. An attorney who specializes in civil litigation can handle various kinds of property disputes. Planting or building on one's property line can result in a property line conflict when one party claims the other breached the boundary.

Torts

Torts are civil lawsuits in which one party claims the other injured them physically or mentally. An individual's financial security, physical safety, or property protection may be at stake in a tort lawsuit. They can also take many different forms. Injuries and accidents often result in assault and violence lawsuits, as well as negligence cases in which one party claims a caregiver failed to perform their duties.

Class Action Cases

Monetary relief

In monetary relief, compensation is provided to those who have been harmed by a defendant's actions. Money relief includes compensatory damages, liquidated damages, nominal damages, incidental losses, consequential damages, etc.

Specific performance

Contractual performance refers to the enforcement of legal liability against the defendant for acts that have not been performed. Through this remedy, the court orders the defendant to fulfill the part of the duty they were unable to fulfill. This performance deficiency led to the lawsuit. Contracting parties are often offered this remedy when one of them fails to fulfill their obligations under their agreement.

Injunction

Defendants are prohibited from acting in a certain way by this remedy. Temporary injunctions and permanent injunctions are the two types of injunctions. During the course of the court case, an interim injunction prevents the party from acting for all time, as opposed to a permanent injunction.

Declarations

By using this remedy, a person establishes his or her rights over a moveable or immovable party. All parties are bound by the judgment rendered by the court. The court outlines each party's obligations and rights in the civil lawsuit. It makes no orders regarding compensation or job performance in this case; it only establishes the parties' rights and obligations.
