Domestic violence in India is addressed under various laws, including the Protection of Women from Domestic Violence Act, 2005, which offers remedies and support to victims of domestic abuse. This law provides for protective orders, residence orders, and financial relief, aiming to safeguard victims and prevent further abuse. At Zolvit, we are committed to offering tailored legal solutions to address all aspects of domestic violence cases, ensuring that you receive the support and protection you need.

Domestic violence in India refers to all forms of abuse, including physical, emotional, sexual, economic, or psychological abuse. It can take a lot of different forms, like physical assault, emotional manipulation, sexual coercion, financial control, or psychological intimidation.

There's a danger of domestic violence in every household, whether it's between spouses, partners, parents and kids, or extended families.

Protection of Women from Domestic Violence Act, 2005 (PWDVA)

In India, domestic violence is regulated by the Protection of Women from Domestic Violence Act (PWDVA). Because of this Act, domestic violence is defined broadly, and victims can get help right away. PWDVA orders include protection orders, residence orders, and monetary relief. Victims can get legal help and support from Protection Officers.

Indian Penal Code (BNS) - Relevant Sections

Section 498A

A husband or relative can be punished with severe penalties under Section 498A of the Indian Penal Code if he or she treats a wife cruelly. It covers physical and mental harassment, including dowry abuse. It's a non-bailable offense to subject a woman to cruelty under Section 498A.

Section 323

In cases of physical domestic violence, this section deals with punishments for voluntarily causing hurt.

Section 377

It's important to remember that although this section is usually associated with other situations, it can also apply to cases of non-consensual sexual acts in a domestic setting.

Dowry Prohibition Act, 1961

The Dowry Prohibition Act specifically addresses the issue of dowry, which is often a root cause of domestic violence in India. Under the act, harassment and violence related to dowry can also be covered by provisions of the IPC and PWDVA, which criminalize giving, taking, or demanding dowry.

The Criminal Law (Amendment) Act, 2013

By amending the law, various forms of sexual violence, including marital rape (in certain contexts) and other forms of sexual assault, are better protected. As part of the legislation, women were better protected within the domestic sphere by expanding the definition of sexual offenses and introducing stricter punishments.

Forms of Domestic Violence

A victim's well-being can be severely affected by various forms of domestic violence. Recognizing them is important for seeking justice and protection. Here are some forms of domestic violence recognized by Indian law:

  • Physical abuse: Including hitting, slapping, punching, kicking, burning, or causing physical injury or pain. Trauma can affect us years after the event has taken place, even if there are no visible injuries.
  • Emotional and psychological abuse: A form of abuse that damages the victim's mental and emotional health, such as constant criticism, threats, humiliation, isolation, or manipulation.
  • Sexual abuse: An act or behavior that is non-consensual, such as forced sexual interaction (including marital rape), unwanted sexual touching, coercion into sexual activities, or sexual exploitation. In addition to emotional and psychological harm, sexual abuse can cause physical injuries as well.
  • Economic abuse: Abuse takes place when the abuser restricts access to money, withholds funds, or prevents the victim from working or managing his or her finances. As a result, financial dependence and long-term instability can result, making leaving the abusive environment difficult.
  • Digital abuse: By monitoring online activity, sending threatening messages, spreading false information, or sharing private images without consent, the perpetrator harasses, stalks, intimidates, or controls the victim. Feelings of entrapment and isolation can be exacerbated by digital abuse.
  • Verbal abuse: Using harsh, derogatory, or threatening language in order to belittle, intimidate, or control the victim, including name-calling, insults, continuous criticism, and verbal threats. It is possible for self-esteem to be eroded and significant emotional distress to result from this type of abuse.
  • Social abuse: This occurs when abusers isolate victims from their social networks, friends, or families, preventing them from interacting with others or communicating with loved ones. As a result, one becomes lonely, helpless, and dependent on the abuser, making it difficult to seek help.
