In India, domestic violence is regulated by the Protection of Women from Domestic Violence Act (PWDVA). Because of this Act, domestic violence is defined broadly, and victims can get help right away. PWDVA orders include protection orders, residence orders, and monetary relief. Victims can get legal help and support from Protection Officers.
A husband or relative can be punished with severe penalties under Section 498A of the Indian Penal Code if he or she treats a wife cruelly. It covers physical and mental harassment, including dowry abuse. It's a non-bailable offense to subject a woman to cruelty under Section 498A.
In cases of physical domestic violence, this section deals with punishments for voluntarily causing hurt.
It's important to remember that although this section is usually associated with other situations, it can also apply to cases of non-consensual sexual acts in a domestic setting.
The Dowry Prohibition Act specifically addresses the issue of dowry, which is often a root cause of domestic violence in India. Under the act, harassment and violence related to dowry can also be covered by provisions of the IPC and PWDVA, which criminalize giving, taking, or demanding dowry.
By amending the law, various forms of sexual violence, including marital rape (in certain contexts) and other forms of sexual assault, are better protected. As part of the legislation, women were better protected within the domestic sphere by expanding the definition of sexual offenses and introducing stricter punishments.
